1. Acceptance of Terms

By accessing or using ScanTheFake ("the Service"), operated at scanthefake.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

ScanTheFake provides AI-powered content authenticity detection. The Service allows users to upload or submit content — including images, videos, text, and URLs — for analysis to determine the likelihood that the content was generated or manipulated by artificial intelligence.

The Service provides probabilistic assessments, not definitive determinations. Results should be interpreted as one data point among many and should not be the sole basis for any consequential decision.

3. Permitted Use

You may use the Service for:

• Personal, non-commercial content verification
• Journalistic and editorial fact-checking
• Educational and research purposes
• Workplace content authenticity verification

4. Prohibited Use

You may not use the Service to:

• Upload illegal, obscene, or harmful content
• Upload content you do not have the right to submit (copyrighted material owned by others)
• Attempt to circumvent security measures, rate limits, or access controls
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated tools, bots, or scripts to access the Service at scale
• Resell, redistribute, or offer the Service (or its results) as your own product
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to harass, defame, or harm others
• Make legal, employment, or disciplinary decisions based solely on scan results

5. Content You Submit

5.1 Ownership

You retain all rights to content you upload to the Service. By uploading content, you grant us a limited, temporary license to process that content solely for the purpose of performing the requested analysis. This license terminates immediately upon completion of the scan.

5.2 Responsibility

You are solely responsible for the content you submit. You represent and warrant that you have the right to submit such content and that it does not violate any applicable laws or third-party rights.

5.3 No Storage

Uploaded files are processed in memory and not permanently stored. We retain only anonymized scan metadata (file type, size, verdict) for aggregate statistics.

6. Accuracy and Limitations

While we strive for high accuracy, AI detection technology has inherent limitations:

• False positives: Authentic content may occasionally be flagged as AI-generated
• False negatives: Some AI-generated content may evade detection, especially as AI models evolve
• Confidence scores reflect statistical probability, not certainty
• Results may vary depending on content quality, format, and compression

The Service is provided on an "as-is" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of scan results.

7. Rate Limits and Fair Use

To ensure fair access and prevent abuse, the Service enforces rate limits and security measures including:

• Maximum of 10 scan requests per minute per user
• Maximum file upload size of 10 MB
• Proof-of-Work computational challenge per request
• CSRF token and session validation

Users who exceed these limits or attempt to circumvent them may be temporarily or permanently blocked from the Service.

8. Intellectual Property

The Service, including its design, code, algorithms, branding, and documentation, is the intellectual property of ScanTheFake and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our express written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCANTHEFAKE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any inaccurate scan results, including false positives or false negatives
• Decisions made based on scan results
• Unauthorized access to or alteration of your content
• Any third-party conduct or content on the Service

11. Indemnification

You agree to indemnify, defend, and hold harmless ScanTheFake and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for any reason, including but not limited to violation of these Terms. Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
